Modisoft, Inc., a Texas corporation, (“Modisoft” or “we” or “us”), hereby adopts this privacy policy (this “Policy”) to disclose our privacy practices with respect to (i) the Modisoft website, modisoft.com, (ii) the products and services offered by Modisoft, and (iii) the point of sale or “POS” system offered by Modisoft (collectively, the “Platforms”). This Policy applies solely to information collected by the Platforms and is intended to notify you of the following:

  1. The security procedures Modisoft has in place to protect the misuse of your information.
  2. What personally and non-personally identifiable information is collected from you through the Platforms, how it is used, and with whom it may be shared.
  3. What choices are available to you regarding the use of your data.
  4. How you can correct any inaccuracies in the information.

Limitations on Access

The various Platforms are intended only for those users located within the United States who are thirteen (13) years of age or older. Certain areas of the Platforms contain information intended only for our customers, and we reserve the right to limit access to such areas to individuals or entities that are our customers and meet our qualification requirements.

Security

We take precautions to protect your information. When you submit sensitive information via the Platforms, your information is protected both online and offline. Modisoft has implemented technology and security policies intended to reduce the risk of unauthorized disclosure or access to sensitive information. We secure your personal information from unauthorized access, use, or disclosure by using secure sockets layer (“SSL”) to restrict such unauthorized practices.

 

Modisoft strives to take appropriate security measures to protect against unauthorized access to or alteration of your personal information. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond Medisoft’s control; and (b) the security, integrity, and privacy of the information and data exchanged between you and Modisoft through our Platforms cannot be guaranteed.

 

Please note that non-encrypted email communication is not secure. Thus, Modisoft cannot guarantee data security in email communication and thus recommend using physical mail for any confidential information.

 

Your Access to and Control Over Information

Modisoft gives you the choice of providing, editing, or removing certain information, as well as choices about how we contact you.  To this end, you may:

 

            (a) change or correct your Modisoft account information through your account settings;

            (b) request the deletion of the personal information in your account; and/or

            (c) opt out of any future contacts from Modisoft at any time.

 

Information Collection and Sharing

Modisoft is the sole owner of the information collected on the Website. We only have access to and/or collect information that you voluntarily give us via email or other direct contact. Modisoft will only share your information with third parties outside of our organization (i) as is necessary to provide the Modisoft products and services (collectively, the “Services”) and process your data, (ii) as set forth in the Terms and Conditions and/or this Policy, or (iii) as you have otherwise provided authorization.  You may also control the receipt of certain types of communications from Modisoft. Modisoft may send you messages about the Services or your activity. Some of these messages are required service-related messages for Users (such as transactional messages or legal notices). Other messages are not required, such as newsletters. You can control which optional messages you choose to receive via the unsubscribe link in our emails. Data obtained through the short code (SMS/MMS Text Messages) program will not be shared with any third-parties for their marketing reasons/purposes.

Use and Sharing of Personally Identifiable Information

Modisoft may use your personally identifiable information to:

 

(a) facilitate your registration for and use of services;

(b) operate the services properly, and improve and update the same;

(c) provide and improve customer service administration;

(d) respond to your questions, inquiries, requests, or other reasons for contacting us;

(e) provide you with information and updates regarding your use of the Services;

(f) send company news, updates, and other related information; and/or

(g) contact you regarding specials, offers, and new products or services.

 

Modisoft may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to:

 

(a) conform to the edicts of the law or comply with legal process served on Modisoft;

(b) protect and defend the rights or property of Modisoft, including intellectual property; and/or

(c) protect the personal safety of our users, customers, or the public.

Use and Sharing of Non-Personally Identifiable Information

Modisoft may use your non-personally identifiable information (i.e., that is not linked to any personal information that can identify any individual person) to:

 

                     (a) create traffic statistics for our Platforms, mobile application, and services;
                     (b) improve services, issue promotions, and improve customer service;
                     (c) personalize the user experience for our customers;
                     (d) provide aggregated demographic information to our customers and other service providers;
                     (e) provide ways for you to compare business practices with other users; and/or
                     (f) create, market, or promote new Modisoft offerings to you and others.

 

Third Party Products

Modisoft partners with other service providers to provide specific services, products, offers, and promotions to our customers (collectively, “Third Party Products”).  When a user signs up for Third Party Products, we will share names and other contact information that is necessary for the third party to provide the same.  These parties are not allowed to use personally identifiable information except for the purpose of providing Third Party Products, and you can anticipate that your data will be treated as provided for by such third party’s privacy policy, as may be updated from time-to-time.

The Website may contain links to sites operated by persons other than Modisoft (collectively, “Third Party Websites”).  The existence of any such links is not, and does not imply, an affiliation, sponsorship, endorsement, approval, investigation, verification, or monitoring of any data, content, or privacy protections offered with respect to Third Party Websites, and Modisoft is not responsible for the same.

 

We encourage our users to be aware when they leave our Platforms and to carefully review the privacy statements of any Third Party Website that collects personally identifiable information.

 

Cookies

Modisoft uses “cookies” on this it’s website and other Platforms.  A cookie is a piece of data stored on a site visitor’s hard drive to help the site improve the visitor’s access and identify repeat visitors.  For instance, when we use a cookie to identify you, you would not have to log in a password more than once, thereby saving time while on our Website.  Cookies can also enable us to track and target the interests of our users to enhance their experience on our Platforms, and their usage is in no way linked to any personally identifiable information.

 

You have the ability to accept or decline cookies.  Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer.  If you choose to decline cookies, you may not be able to fully experience the interactive features of the Services or websites you visit.

 

Some of our third-party service providers and/or partners (such as advertisers) may use cookies on our Platforms.  However, we have no access to or control over these cookies.

 

Prospective Service Providers Registration

In order to offer your services to our cooperative association as a prospective vendor or instructor, you must first complete a registration form.  You understand that the registration form in no way makes it incumbent upon Modisoft to obtain your services.  During registration you will be required to give certain information (such as name, email address and pricing).  This information will be used to contact you about the products and/or services which you have expressed interest in providing our customers.  At our option, we may use this information in our general body meetings to discuss whether or not to accept your products and/or services.

Updates to Privacy Policy

Modisoft may update this Policy at any time by posting an amended version on the Website.  The amended Policy shall become effective upon posting.  Modisoft will also notify its customers of any updates or changes to the Policy via email to the Current Administrator’s email address provided in the Registration Data.  Your continued use of Modisoft services subsequent to any modification(s), addition(s), or deletion(s) of any portions of the Policy shall be deemed to constitute your acceptance of the same.  Please visit this page from time to time to view our most updated Policy.  If at any time you feel that we are not abiding by this Policy, please contact us immediately via telephone or email.
